Update On Post Trial/Appeal Matters: Merck Vs. Gilead Hep C Delaware Federal Court Patent Spats…

mrk-alt-gil-verdict-hep-c-12-15-16 We all knew there would be appeals filed. [Here’s the last update I wrote on this.]

But by tomorrow afternoon, we should have a better line on when that multi-billion dollar patent infringement judgment from the able Judge Stark (sitting in the federal District courthouse in Wilmington, Delaware) will be published. That’s per the below oral order:

. . . .ORAL ORDER: IT IS HEREBY ORDERED that the parties shall file a joint status report by no later than Wednesday, January 25, 2017, providing an update regarding their efforts to finalize an agreement with respect to the ‘054 patent (see D.I. 520 at 1-2) and containing their position(s) as to whether the Court should enter judgment promptly.

ORDERED by Judge Leonard P. Stark on 1/23/17. . . .

Now you know — onward on a gray but busy Tuesday morning — much to decide in the coming week. . . . smile.

      Well, for the comprehensive CA-DE analysis, you’ll need to subscribe to my pay site — for a low $19.95 per month, two year commitment!

      Just kidding. I’ll make some (more) guesses, on all of that. . . soon-ish — as my day-gig responsibilities permit.

      As to your first question, though — I did post that status update, right here. And now — we should see the judgment and opinion entered any day, in the public record, on the electronic federal court docket in Delaware.
